1. DEFINITION
For the purposes of these Terms and Conditions:
“AHPRA” | means the Australian Health Practitioner Regulation Agency. |
“Client”, “you” | refers to any individual who seeks cosmetic Treatments at CosLux and is voluntarily engaging in Treatments after being informed of the associated risks and benefits. |
“Client Information” | refers to all personal, medical, and Treatment-related data collected from the Client by CosLux. This includes, but is not limited to, identification details, medical history, Treatment preferences, consent documentation, Images, and any communications with the Clinic. |
“Content” | means all materials made available on the Website, including but not limited to text, graphics, images, logos, icons, videos, audio clips, downloadable documents, design layouts, software, and any other information or materials displayed or accessible on the Website, whether created by CosLux or licensed from third parties. |
“Cooling-Off Period” | refers to the recommended 24-hour waiting period before a Client undergoes a Treatment for the first time, which may be waived at the Client’s discretion by signing a waiver. |
“Coslux”, “Clinic”, “we”, “us”, and “our” | refer to CosLux Cosmetic Clinic. |
“Images” | refers to all forms of visual media collected during or related to the Client’s Treatment at CosLux, including but not limited to photographs, videos, digital recordings, and other visual representations. Images may be used for internal training, educational purposes, promotional materials, marketing, and personal record-keeping, with the Client’s consent. |
“Practitioner” | refers to a qualified healthcare professional authorised to perform Treatments at CosLux. This includes, but is not limited to, doctors, nurses, or other licensed professionals trained and certified in cosmetic treatments. |
“Pre-Treatment Pack” | refers to the suite of documents issued to Clients prior to Treatment, which includes the Client Information Booklet, Treatment Consent Form(s), Cooling-Off Period Waiver, Treatment Against Medical Advice Agreement (if applicable), and Photo & Marketing Consent Form. |
“Privacy Policy” | means the privacy notice published on the Website that outlines how CosLux collects, stores, uses, and discloses Client Information. It also reflects CosLux’s commitment to ongoing compliance with privacy law reforms, including anticipated updates to the Privacy Act 1988 (Cth) such as the proposed statutory tort for serious invasion of privacy and emerging offences such as doxxing. |
“TGA” | means the Therapeutic Goods Administration. |
“Treatment” | means any prescription-only aesthetic procedure provided by CosLux, including but not limited to anti-wrinkle injections, dermal fillers, skin boosters, and other non-surgical cosmetic treatments. |
“User” | means any person accessing, browsing, or interacting with the Website, whether or not they become a Client. |
“Website” | means the CosLux Cosmetic Clinic website, including all subdomains, online booking systems, content, and any other web-based services or digital interfaces operated or controlled by CosLux. |
2. ACCEPTANCE OF TERMS
By accessing or using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, our Privacy Policy, and any other applicable policies referenced herein.
If you do not agree with any part of these terms, you are not authorised to access or use this Website and should discontinue use immediately.

5. APPOINTMENTS AND CONSULTATIONS
At CosLux, we are committed to providing Treatments that adhere to ethical and evidence-based practices. All Treatments are subject to a comprehensive suitability assessment conducted by a Practitioner.
We do not provide Treatments to individuals under 18 years of age or those who are pregnant or breastfeeding.
5.1. Booking confirmation
Appointments scheduled through our Website or booking platform are considered tentative and subject to confirmation by CosLux.
We reserve the right to modify or cancel appointments as necessary, and we will provide as much notice as possible in such cases.
5.2. Pre-Treatment requirements and Cooling-Off Period
Prior to any Treatment, Clients are required to complete the CosLux Pre-Treatment Pack. This includes providing personal and medical history, Treatment preferences, and all relevant consent documentation.
The Pre-Treatment Pack will be issued at least 24 hours in advance of the Client’s proposed appointment. CosLux strongly recommends that Clients use this time as a Cooling-Off Period to review the Treatment information, risks, and their rights before booking or attending the Clinic.
All documents included in the Pre-Treatment Pack must be completed and submitted prior to the scheduled appointment. Failure to do so may result in the rescheduling or cancellation of the appointment.
If a Client chooses to proceed with Treatment within 24 hours of receiving the Pre-Treatment Pack, a signed Waiver of Cooling-Off Period form will be required.
5.3. Consultation process
The information submitted in the Pre-Treatment Pack enables our Practitioners to conduct an efficient and focused consultation to confirm suitability, discuss any remaining questions, and finalise the Treatment plan.
This approach ensures that all Treatments remain safe, appropriate, and aligned with the Client’s goals, without requiring lengthy in-Clinic consultations.
5.4. Treatment eligibility
CosLux reserves the right to decline or postpone Treatments based on the professional judgment of our Practitioners.
Factors influencing such decisions may include, but are not limited to, medical contraindications, Client expectations, and overall health status.
6. CLIENT RESPONSIBILITIES
By booking with CosLux, you confirm and agree to the following:
- Age requirement: You are at least 18 years of age. CosLux does not provide Treatments to individuals under 18.
- Accurate medical information: You will provide complete and accurate personal and medical information as requested. This includes disclosing any changes in your health status, medications, or other relevant factors prior to each appointment.
- Completion of Pre-Treatment Pack: You will complete and submit all required digital forms included in the Pre-Treatment Pack before your scheduled appointment.
- Cooling-Off Period: You acknowledge the importance of the Cooling-Off Period provided after receiving the Pre-Treatment Pack, allowing you to review all relevant Treatment information and make an informed decision.
- Understanding of Treatment outcomes: You understand that individual results may vary due to factors such as age, skin type, lifestyle, and adherence to aftercare instructions. CosLux does not guarantee specific outcomes.
- Compliance with aftercare instructions: You agree to follow all aftercare instructions provided by CosLux to ensure optimal results and minimise potential risks.
- Timely communication: You will promptly inform CosLux of any concerns, adverse reactions, or complications following your Treatment.
Failure to adhere to these responsibilities may result in the rescheduling or cancellation of your appointment and could impact the safety and efficacy of your Treatment.
7. PRICING AND PAYMENTS
7.1. Advertising restrictions for Treatments
CosLux is committed to operating in full compliance with AHPRA and TGA.
We do not advertise prescription-only medications, promote brand names, or offer pricing incentives in connection with such treatments. All advertising and communications are subject to the advertising restrictions under the Therapeutic Goods Act 1989 (Cth) and related TGA guidance.
All consultations are conducted in accordance with current medical and ethical standards.

7.2. Pricing and Fees
Treatment fees are individualised and will be discussed in detail during your consultation.
Factors influencing the cost include, but are not limited to:
- The specific Treatment(s) recommended.
- The complexity and scope of the Treatment(s).
- Any additional services or products that may enhance Treatment outcomes.
Please note that all pricing is subject to change and will be confirmed during your consultation. A detailed breakdown of costs will be provided, ensuring transparency and allowing you to make an informed decision.

7.3. Currency and payment terms
Prices for Treatments will be quoted in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST), where required.
Payment is due at after the Treatment unless an alternative arrangement has been agreed to in writing.
7.4. No fee guarantee or advertising
In compliance with AHPRA and TGA advertising guidelines, CosLux does not offer:
- Treatment packages or bundled services;
- Price promotions, discounts, or incentives related to the Treatments; and
- “Before and after” discounts or comparative imagery that may imply guaranteed outcomes.
All promotional activities are conducted in accordance with current healthcare advertising regulations to ensure ethical and responsible communication.
7.5. Refunds
CosLux is committed to providing high-quality services tailored to individual Client needs. As such, we maintain the following refund policy:
- Refunds are not provided for change of mind once a Treatment has been administered.
- Refunds will only be issued in accordance with the Australian Consumer Law (ACL), which includes guarantees that services will be provided with due care and skill, will be fit for purpose, and will be delivered as agreed.
- CosLux does not exclude or limit any consumer guarantees, rights, or remedies available to Clients under the ACL.
- All refund requests must be submitted in writing and will be assessed on a case-by-case basis.

8. PRIVACY
CosLux is committed to safeguarding the privacy and confidentiality of your personal information. Any personal or health-related data collected through the Website — including when booking an appointment, completing the Pre-Treatment Pack, or submitting an enquiry — is handled in accordance with the Privacy Act 1988 (Cth) and all applicable Australian privacy laws.
This includes, but is not limited to:
- Contact details (such as name, email, and phone number),
- Medical history and Treatment preferences,
- Information submitted via consent forms or questionnaires, and
- Any correspondence or feedback you provide to us.

Access to your data is restricted to authorised personnel only and is used solely for purposes directly related to your care, Treatment planning, or Clinic operations.
We recommend that you do not submit sensitive information (such as medical details or photographs) via unsecured online platforms, unless it is submitted through the Clinic’s secure digital portal. For all other sensitive matters, please contact the Clinic directly.

9. PHOTO & MARKETING CONSENT
CosLux is committed to respecting and protecting Client privacy.
We will not use any Images for marketing, promotional, or educational purposes without obtaining explicit, written consent through our Photo & Marketing Consent Form. This consent is entirely voluntary and separate from the consent provided for Treatment procedures.
Clients have the right to:
- Decline consent: You may choose not to have your Images used for any external purposes.
- Specify usage: If you provide consent, you can specify the platforms (e.g., Website, social media) and duration for which your Images may be used.
- Withdraw consent: You may withdraw your consent at any time by providing written notice to CosLux.
All usage of Images will comply with AHPRA Advertising Guidelines and relevant privacy laws. We will ensure that Images are used responsibly, without misleading representations, and with appropriate disclaimers where necessary.
10. INTELLECTUAL PROPERTY
All Content on the Website, including but not limited to text, images, graphics, logos, videos, audio clips, design elements, and the overall layout, is the property of CosLux or its content suppliers and is protected by applicable copyright, trademark, and other intellectual property laws.
